SUREEN PLATFORM – TERMS AND CONDITIONS
First: Introduction
Welcome to Sureen Platform. These Terms and Conditions, along with our Privacy Policy and all other applicable policies published on the Platform, govern your use of Sureen and serve to protect the rights of both:
- Sureen Platform (the First Party)
- Users (customers) whether registered or unregistered (the Second Party)
By accessing and using Sureen, you confirm your acceptance of these terms without modification, limitation, or qualification. You also confirm that you have the legal capacity to enter into this agreement.
Note: All terms herein are subject to the laws and regulations of the Kingdom of Saudi Arabia.
1. Definitions
“Customer” includes individuals, entities, or companies using the platform to sell, rent, buy, or promote properties (including brokers, offices, marketers) who accesses the platform and benefits from its services directly or indirectly, whether by registration or without registration, and is represented here the second party.
“Advertiser” is the party listing a property on the platform.
“Platform” refers to Sureen’s digital interface (website, app, etc.).
2. General Terms of Use
By using the platform, you agree to:
- Not post or promote any item outside the scope of real estate.
- Not post false, misleading, defamatory, or unauthorized content.
- Not replicate, copy, or redistribute any ad or platform content.
- Not use bots, scrapers, or unauthorized tools to access platform data.
- Not access or attempt to access another user’s account without permission.
- Not post or transmit any viruses, malware, or harmful content.
- Not take any actions that harm, overload, or compromise the platform infrastructure or its reputation.
- Not impersonate Sureen, its employees, or representatives without written authorization.
- Comply with all applicable Saudi laws and platform guidelines.
3. User Responsibilities
As a user of the Sureen platform, you are obligated to:
- Ensure all information provided is accurate and truthful.
- Use the platform only for lawful purposes.
- Respect others’ rights, including intellectual property rights.
- Keep your account credentials secure and confidential.
- Not transfer your platform account to another party.
- Pay all applicable fees and commissions on time.
If Sureen identifies any violations, it reserves the right to:
- Issue warnings and request corrective action.
- Remove content without prior notice.
- Suspend, limit, or terminate access to the platform.
- Cancel active advertisements.
- Report your activity to the relevant authorities.
- Pursue legal action.
Advertising Terms:
- Advertise only real estate-related content (sale, rental, lease).
- Provide complete, accurate, and up-to-date property information.
- Use real photos of the actual property.
- Continuously monitor and update the listing status.
- Respond to inquiries and messages promptly.
- Remove the ad once the property is sold or rented.
- Not copy or reuse any advertisement or image from the platform.
- Post your ad in the appropriate category/section.
Sureen reserves the right to delete any ad without explanation.
Enforcement and Legal Jurisdiction
Sureen will enforce these terms to:
- Protect user data.
- Ensure transparency and trust among users.
- Combat fraud, deception, and illegal practices.
- Maintain a safe and professional business environment.
All legal matters related to these Terms and Conditions will be subject to the jurisdiction of the Kingdom of Saudi Arabia.
Third: Responsibility of Sureen
3.1 Platform Purpose and Scope
Sureen Platform was created to serve as a comprehensive digital hub for all types of real estate services across the Kingdom of Saudi Arabia. It enables users to search for properties, advertise listings, and communicate directly with advertisers.
Important: Advertisers are solely responsible for the accuracy and legality of all information provided in their listings, including any supporting documentation. They are also fully accountable for complying with all applicable Saudi laws and regulations governing real estate sales and marketing. Sureen automatically classifies advertisers (e.g., real estate offices, marketers) based on their activity and usage on the platform.
3.2 Platform Disclaimer and Liability Limitation
Sureen Platform does not provide guarantees regarding the conduct, compliance, or credibility of platform users. We assume no responsibility or liability for any losses, damages, or claims arising from:
- Non-compliance with the Terms of Use;
- Acts or omissions by any user, advertiser, buyer, seller, or third party;
- Any fraudulent, misleading, or illegal activity carried out by users.
Affected parties are encouraged to report incidents via email to: Support@sureen.sa. Sureen will assess each case and take appropriate actions at its sole discretion without accepting liability.
3.3 Complaint Handling and Documentation
Sureen is committed to maintaining the integrity of its services. All complaints, violations, and reports submitted will be documented, archived, and may be submitted to relevant authorities when necessary or upon official request.
Users are also advised to review the Sureen Security Policy for steps to take when facing potential risks or damage.
3.4 Data Use and Monitoring
By registering on Sureen Platform, you:
- Authorize us to store, access, and review your submitted data on our secure servers;
- Grant us the right to monitor private messages if needed to ensure compliance with our Terms of Use;
- Agree that Sureen may remove advertisements, delete images, or suspend membership accounts, without prior notice and without obligation to disclose reasons.
3.5 Accuracy of Listings and Independent Verification
While Sureen aims to provide accurate real estate listings, the details are provided by advertisers or third parties, and we do not verify or guarantee their accuracy. Users must:
- Conduct their own due diligence;
- Seek legal, financial, or property advice before proceeding with any transaction;
- Accept full responsibility for confirming the reliability and legality of any listing.
3.6 Limitation of Liability
Sureen shall not be liable for any direct or indirect damages or losses resulting from:
- Technical failures, including network, software, or platform unavailability;
- Loss of access due to user-side issues, including forgotten passwords or hardware malfunctions;
- Reliance on any content or listing posted on the platform;
- Any viruses, cyber-attacks, or other harmful technological materials transmitted through the use of Sureen;
- Commercial or business loss, including but not limited to:
- Loss of profits
- Loss of data or reputation
- Loss of opportunity or goodwill
- Any consequential, punitive, or special damages
Unless explicitly agreed to in writing, the Platform must not be used for commercial or business purposes unrelated to its intended use.
Fourth: Information Agreement
4.1 Data Privacy Commitment
We value your concerns regarding the privacy and security of your personal data on the Internet. This section outlines our data handling practices and explains how your information is collected, used, and protected when you access or use the Sureen Platform.
4.2 Principles of Data Collection and Use
Purposeful Data Collection: We will not collect personal information unless there is a clear and legitimate reason for doing so. Your data is collected strictly to fulfill specific purposes and, when necessary, for any compatible objectives as permitted by applicable laws.
Consent-Based Collection: We collect personal data with your knowledge and consent, and only through lawful means. No further information will be collected or used without your express approval where legally required.
Data Retention: We retain personal information only for as long as necessary to fulfill the stated purposes or as required by law or regulatory obligations.
4.3 Consent to Data Disclosure and Verification
By applying for services through Sureen, you agree to:
- Provide accurate personal and account-related information as necessary for the creation and operation of your user account.
- Authorize Sureen to obtain necessary or relevant information related to you or your account, including from the Saudi Credit Bureau (SIMAH).
- Permit Sureen to share your data with SIMAH and/or any third party authorized by the Saudi Central Bank (SAMA) in accordance with applicable regulations, our membership agreement, and industry data-sharing practices.
4.4 Information We Collect
Sureen may collect and process the following types of data:
- Personal Information: Full name, email address, mobile number, device type, and IP address.
- Verification Documents: Identification papers, ownership deeds, and supporting documentation required to classify listings (e.g., “Notarized”) or verify business memberships.
- Advertisement Data: Property images, listing details, and content posted to the platform.
- Technical and Behavioral Data: Information about your activity on the platform, including browsing behavior and device identifiers.
4.5 Purpose of Data Usage
Collected data is used for the following:
- Personalized Experience: To tailor platform content and services to better meet your individual needs.
- Platform Enhancement: To improve Sureen’s performance, user interface, and service delivery based on user feedback and behavior analytics.
- Customer Service Improvement: To respond more effectively to customer inquiries and support needs.
- Communication: To send notifications, email updates, SMS messages, service announcements, or promotional communications via any available channel.
- Research and Reporting: To generate market statistics, real estate reports, user analytics, and to support payment transaction tracking.
- Authorized Data Sharing: To share necessary information with trusted third-party partners (e.g., government agencies, banks, analytics providers).
- To comply with legal requests or court orders from law enforcement or regulatory bodies.
4.6 User Responsibility
You are fully responsible for maintaining the confidentiality of your password and account information.
We strongly advise you to exercise caution and take all necessary measures to secure your account, particularly when accessing the platform from shared or public devices.
Fifth: Intellectual Property
Unless expressly stated otherwise, all content on the Sureen Platform— including text, graphics, logos, images, software, and other materials—is the intellectual property of Sureen, its affiliates, or third parties who have granted Sureen the appropriate licenses. This content is protected by applicable copyright, trademark, and intellectual property laws. Sureen, its licensors, and suppliers reserve all rights in and to the intellectual property appearing on the Platform. Accessing the Platform does not grant any user a license or right to use any of this intellectual property.
You may not copy, reproduce, store, modify, distribute, or republish any content from the Platform for commercial purposes without prior written consent from Sureen. All names, logos, service marks, and trademarks displayed on the Platform are owned by Sureen or its licensors. No license or right to use any such marks is granted by your use of the Platform. Access to the Platform does not authorize the use of any images, logos, or names appearing therein for any purpose.
Sixth: Consent to Assignment of Financial Obligations
The Tenant hereby irrevocably acknowledges and agrees that Sureen, or any of its affiliates, has the right to transfer or assign any financial obligations arising from lease agreements (including through the Ejar system) to a third party, such as a financial institution, without the need for prior notice or further consent from the Tenant. The Tenant’s acceptance of Sureen’s terms and conditions and completion of contractual procedures shall be deemed explicit and unconditional consent to such assignment. Regardless of the assignee, the Tenant remains fully responsible for fulfilling all payment obligations under the lease agreement.
Seventh: Indemnification
You agree to indemnify and hold harmless Sureen, its affiliates, and their respective employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of or access to the Sureen Platform;
- Your violation of these terms or any applicable law;
- Any content or material you submit or upload;
- Infringement of any third-party intellectual property or other rights.
Eighth: Security Policy
Sureen is committed to platform integrity, data privacy, and compliance with applicable laws in the Kingdom of Saudi Arabia. While Sureen strives to maintain a secure environment, it is not a party to disputes between users arising from any breach of the platform’s terms. Sureen reserves the right to investigate violations of its policies and take appropriate action against individuals, businesses, or institutions that misuse the platform, which may include suspension, deletion of content, or legal proceedings through the relevant authorities.
Sureen is operated by Sureen Company, a Limited Liability Company registered in the Kingdom of Saudi Arabia with its main office located in Riyadh.
Users must read and agree to the platform’s terms and conditions before entering any lease agreements, as these govern their legal obligations and rights regarding rental payments and termination. Sureen reserves the right to amend these terms at any time for legal, regulatory, or operational reasons. Continued use of the platform constitutes acceptance of the updated terms.
Ninth: Commitment Policy
Upon signing a lease through Sureen, the Tenant must select a monthly due date for rent payments.
If the Tenant fails to pay rent within 7 days of the due date, Sureen may initiate legal proceedings via the Execution Court. A legal fee of up to SAR 1000 will be added to the Tenant’s account, shown as a separate invoice. Additionally, the court may impose an extra SAR 500 in legal costs.
If the Tenant fails to pay on time more than once during the lease term, Sureen reserves the right to demand eviction. An eviction application may incur a legal fee of up to SAR 7,000. In case of late payment, Sureen will notify the Saudi Credit Bureau (SIMAH) or any authorized bureau, which may negatively affect the Tenant’s credit rating. Delays in payment will also impact Sureen’s future dealings with the Tenant, including lease renewals and approvals.
Tenth: Lease Termination Policy
Tenants must fulfill the full term of the lease as stipulated in the agreement.
If a Tenant wishes to terminate the lease early, they may submit a request and propose a replacement Tenant willing to take over the lease. Sureen reserves the right to approve or reject the new applicant. Until the new Tenant is formally approved and a lease is signed, the original Tenant remains liable for all rental payments. Lease cancellation requests will not be processed unless all outstanding payments and obligations are settled.
